How Failing to Comply with Medical Treatment Could Impact your Disability Claim

doctor and patientWhen applying for Social Security Disability (SSD) benefits, it is important that you have sought treatment for your condition and have complied with any recommendations from your doctor. Failing to comply with medical treatment could limit your ability to get benefits.

In order to determine how credible your claims are about the debilitating qualities of your condition, the Social Security Administration (SSA) must have documented medical evidence that proves the extent of your condition. If you have not spoken with a doctor or sought treatment, the SSA may conclude that your condition is not as limiting or as severe as you say.

There are some steps you can take to bolster your credibility and increase documentation if you are unable to provide documentation of treatment.

Acceptable Reasons for Failing to Comply with Medical Treatment

The SSA understands that under some circumstances it may be difficult for an applicant to get medical documentation or treatment for their condition. This can include situations in which:

  • A medication’s side effects are worse than your symptoms
  • A doctor informs you that no treatment will be effective
  • Your insurance coverage is not sufficient
  • You can plan your activities around your condition to minimize or avoid symptoms
  • Receiving medical treatment goes against your religious beliefs

If you cannot engage in a certain treatment, it is important that you provide a valid explanation in your application.

You should also provide as much information as possible about the treatments you have had. You should keep detailed records of any additional treatments you have tried like acupuncture, meditation, chiropractors, mental health counselors or over-the-counter medications and include them in your application. The more information you provide that documents your treatment for your condition, the more credible you appear to the SSA.
